The Boeniger Effect

27 September 2021

Honorable Portsmouth Town Clerk Jennifer M. West

Office of the Portsmouth Town Clerk

2200 East Main Road

Portsmouth, RI  02871

Honorable Clerk West:

Under the Rhode Island Access to Public Records Act, §38-2-1 et seq., I am requesting an opportunity to inspect or obtain copies of public records that deal with claims made by the company known as Green Development LLC.

According to Green Development’s website, they “Removed and Replaced the Town of Portsmouth’s Turbine and paid off the town’s debt.”  I would like a copy of all communications whether written or electronic between the town and the company known as Green Development during this process.  I would like a copy of all internal communications, whether written or electronic, regarding the “paying off of the debt.”  If a picture exists taken by Town personnel of the “replacement” turbine, I would like a copy of that.  In all cases, because they are less expensive overall and less time consuming for your team, electronic copies are always preferable.

If there are any fees for searching or copying these records, please inform me if the cost will exceed $200.  The Rhode Island Access to Public Records Act requires a response time within ten business days.  If access to the records I am requesting will take longer than this amount of time, please contact me with information about when I might expect copies or the ability to inspect the requested records.  If you deny any or all of this request, please cite each specific exemption you feel justifies the refusal to release the information and notify me of the appeal procedures available to me under the law.

Thank you for considering my request.

Sincerely,

Robert T. Oliveira
