Observing The Process

Office of the Iowa Attorney General

1305 E. Walnut Street

Des Moines, Iowa  50319

Honorable Attorney General Miller:

I hope this message finds you well.  I have been to your state twice – once just before the Caucuses and once in dead summer.  I can only imagine how pretty it is around the Solstice and Christmas. May the Solstice Season bring you and your family the blessings of all 29 Holidays.

This is not going to be fair, but it’s true.  I am sure that when a potential hate crime is committed in your state, you have a vetting process that might take weeks if not months to decide whether you should categorize it as as such.  Here we are just a weekend in and many of us are wondering why Nicole Marie Poole has not been charged with a hate crime as of yet. I am hoping to find out that the delay is process related.

I took a look at the Violent Crime Control and Law Enforcement Act of 1994.  This crime fits. I reviewed Iowa Code 729.A.2. That section specifically refers to crimes based on “ancestry”.  Once again the hate crime definition fits.

Some folks are not satisfied with the “process suggestion”.  They wonder if in the time of Donald Trump, who obviously inspired the incident, if everything is “rigged”.  Again, I have only been to your state twice. Both times, folks were welcoming to everyone. I expect out and out racism in other places but not Iowa.  Therefore, I don’t think that is a factor in your decision.

If I am totally wrong about the nature of things on the ground, please let me know.  A PAC can be established in Iowa rather quickly just to accomplish this purpose. If you are feeling an inordinate amount of political heat and it is affecting your decision, that can be handled as well.  Those of us who think it should be a hate crime can reach out to the FBI Field Office in Omaha and make our application there. Technically, I would reach out to a friend in the Utica, NY FBI Field Office and have them reach out to Omaha but you get the idea.

Just so you are not surprised, many of us are going to reach out to the victim as well.  She should have an attorney just in case Ms. Poole has any assets whatsoever. In the case of any Trump supporter, we need to send a message.  In the case of any victim of a Trump supporter, we need to make them whole as quickly as possible.

If you have any questions, please do not hesitate to contact me.  Thank you for your time and consideration.

Sincerely,

Robert T. Oliveira
