Dear Justice Chun:
I hope this message finds you well. I do not expect this letter to make you happy nor do I expect you to take any of it to heart. This letter is much more about the functionality of the situation you are in instead of the emotional content.
When I first read about your decision to put two former rapist cops on probation, I was angry. Then when I read about your reasoning, I got angrier. New York is a cool place because due to the 1800’s political methodology infused with the Compare politics model, ballot fusion, and the election of judges in some places, you can literally run through a judge’s life and leave nothing in your wake via the free market whether the judge in question was originally elected or appointed.
When a number of us got together and talked about what your decision meant for women, that was the path you were on. Then I did something I am happy I did. I looked at some of you other decisions – a few of them just as bad – and learned more about you. It turns out you are not a worthless sexist who doesn’t understand what goes through a woman’s mind when she gets raped. For the record, if I had not spent as much of my life helping women find recovery, I would not know about that as well.
It turns out you are just one of those people who spent time as a prosecutor and that time colors your decisions. We see this most clearly when a cop shoots somebody, normally of a different color than the cop, for selling water and the local DA can’t even get an indictment for assault. A lot of people scream “corruption”. In reality, it is normal relationship closeness.
In order to have a civilized society, we have to get around this. Bad cops, especially racist cops, cannot be made to feel comfortable in knowing that they can commit whatever crime they want and the local prosecutor, or in your case judge, is going to feel too close to them instead of doing the right thing. It happens over and over again.
Now that we know that you are part of a larger problem, you once gave a soft sentence to someone who beat somebody blind due to your relationship deficiency, and not a sexist not fit for civilized society, we can not apply the free market to your life. A judge is Boston is not going to be as lucky. That leaves us with the two cops who you let get away with rape.
Yes, we can apply the free market to them but we have to do so carefully. First of all, we don’t want cops looking over their shoulders on the street. That could get somebody killed. We don’t want our methods that we might apply against a bad cop used against a good cop. Lastly, besides making the two rapists known for their rape and the regular problems that will cause in their lives, what can we do further where the punishment will still fit the crime??
I wish this wasn’t the world in which we lived in. I wish racists, sexists, and bigots did not cause us to look for free market solutions on a daily basis. I wish folks who served as prosecutors like you could be trusted to handle cop cases. I wish the law enforcement community didn’t continually attract racists.
However, that is not the world in which we live. For you, feminists are going to hate you forever. The two cops will be looking over their shoulders forever since they now have the rapist tag. Sadly, the young lady who get raped did not get justice. Yes, we all have much work to do.
